RNC, Trump Campaign and Nevada GOP Fight Back Against Democrats’ Radical Election Abuses

WASHINGTON – The Republican National Committee, Donald J. Trump for President, Inc., and the Nevada Republican Party filed a lawsuit against the state of Nevada to stop the implementation of Assembly Bill 4 (AB4), which significantly changes the rules for the Silver State’s November election and puts the democratic process at risk. This lawsuit is part of the RNC’s continued efforts to fight back against Democrats’ assault on the integrity of our elections.

With less than 100 days until Election Day, Governor Sisolak and the Democrat-led Legislature used the cover of the COVID-19 pandemic to introduce and pass AB4 in less than 72 hours, and with little public notice. The legislation forces country registrars to mail ballots to all registered voters, legalizes ballot harvesting, allows for the potential of counting two mail ballots returned in one envelope, and lets ballots be counted if they arrive days after Election Day with no postmark. Additionally, this law could have ramifications far beyond 2020 as the new provisions will apply to any election held during a declared emergency or state of disaster, defined in the bill as an “affected election.”

Nevada’s top election official, Secretary of State Barbara Cegavske, was not consulted on AB4 and only received a copy of it an hour before it was heard in the Assembly. Cegavske had previously released her plan to allow Nevadans to vote safely, and testified to the legislature that ballot harvesting would be “devastating” to the Silver State.

The RNC, Trump Campaign, and Nevada Republican Party are suing the State of Nevada over several provisions of AB4 that violate the United States Constitution. For example:

  • The newly enacted law not only requires election officials to accept and count ballots received after Election Day, but creates a loophole that allows votes to be cast after Election Day.
  • The law will guarantee most rural counties only one in person polling place for early voting and on Election Day, while urban, Democrat-leaning counties may receive 35 or more early voting locations and over 100 Election Day polling places. These provisions clearly treat rural voters differently than urban voters simply based on where they live.
  • The law also fails to provide uniform safeguards for processing and counting ballots and allows the county or city clerks to establish these procedures. This will inevitably lead to voters being treated differently depending on where they live.
  • The law even allows county or city clerks to count ballots that are marked by voters who failed to comply with the signature-verification process, including situations where two ballots are folded together and sent in a single envelope–a loophole that invites fraud and ballot manipulation.

Background:

Until June’s disastrous primary in Nevada, the state had never automatically mailed ballots without real voters requesting it. By sending live ballots to hundreds of thousands of voters who did not even request them, excess ballots piled up in public trash cans and were found strewn about Las Vegas apartment complexes, even forcing a postal worker to say “something stinks here.” Nevada is already an absentee friendly state that makes it easy for individuals to vote, yet Democrats continue to try and change the rules for their partisan benefits.

The RNC continues to fight back against the Democrats’ assault on the integrity of our elections by intervening in left-wing backed lawsuits across the country. Recently, the RNC intervened in Iowa to prevent third parties from filling out personal information on absentee ballot requests.  The RNC was handed a major victory when Priorities USA and the Democrat plaintiffs dismissed every substantive claim in Nielsen v. DeSantis, a radical lawsuit brought in Florida that among other things, sought to force Florida to count ballots that arrive after Election Day and strike down the state’s ban on ballot harvesting. This comes on the heels of a victory in California when the RNC voluntary dismissed a case after defeating Governor Newsom’s unconstitutional Executive Order that would destroy California’s election integrity. Additionally, the RNC intervened to protect election integrity in Minnesota against Democrat attempts to remove ballot deadlines by Election Day and prevent the sending of ballots to inactive voters. The Republicans recently sued Clark County in Nevada for hiding evidence of a shady backroom election deal. The Commonwealth Court of Pennsylvania also recently handed Republicans a big victory, throwing out a left-wing lawsuit to allow ballots to be counted after Election Day. Similar radical lawsuits are being fought in states like Michigan, New Mexico, and Arizona.
